Family Law
We have a full-service Family Law Practice that includes contested and non-contested divorces, child custody and visitation, child support awards and enforcement, post-minority support, modification proceedings, asset protection issues, juvenile dependency, termination of parental rights, paternity determination proceedings, adoptions, grandparent rights and restraining orders stemming from allegations of domestic abuse.
We represent family law clients from all walks of life and handle matters from the simple to the complex. Our family law clients include: business owners and executives who need to protect their ownership interests in the event of a divorce; couples or relatives considering adoption; grandparents who want to establish visitation or custody rights; parents of special needs children who may be eligible to receive post-minority support; individuals seeking non-contested and contested divorce; and victims or those accused of domestic abuse who may need the protection of the courts.
We recognize that many of our clients, along with their children and loved ones, are involved in stressful and complex personal and legal situations, and we strive to provide the representation, assistance and guidance that will enable them to move forward with their lives. We also handle appeals from adverse rulings in litigated cases if we believe the appealable issues have merit.
Estate Planning
The firm’s Estate Planning and Probate practice includes consultation and planning sessions with clients who may need basic estate planning documents such as Wills, Powers of Attorneys, and Advance Health Care Directives. Many of our clients are choosing Revocable Living Trusts as an alternative to traditional wills, and some require more advanced or special needs trust planning. We provide the planning and implementation services necessary to ensure that our clients are addressing their individual needs in order to maximize estate benefits and protect and preserve estate assets.
Probate
Our Probate Practice includes the representation of personal representatives, beneficiaries, guardians, and fiduciaries in Probate and Estate Administration proceedings and Will challenges. In the area of probate administration, we work to make sure that debts, taxes, and expenses of the estate are properly taken care of and that the assets of the estate are distributed properly in accordance with the terms of a valid will or the applicable laws of intestate succession. We also handle Guardianship and Conservatorship proceedings and other matters that originate in Probate Court, helping to make sure that minors or incapacitated adults are properly taken care of in the management of their financial affairs and in their health and welfare.
Business and Corporate
The Business and Corporate practice includes: entity selection and formation services; corporation, limited liability company and partnership organizational documents; corporate governance; shareholder and founder agreements; buy-sell agreements; acquisitions; non-compete, non-solicitation and confidentiality agreements; stock option documents; employee handbooks; human resource and compliance counseling, and other employment law matters; commercial litigation; real estate litigation; and standard property conveyances.
We believe our experience in business and corporate matters complements our Family Law, Estate Planning and Probate Practices. For example, in a growing number of cases, we are called upon to provide representation for entrepreneurs and shareholders who are concerned with the protection of business assets and ownership issues in the event of a divorce. The business side of divorce is ever-prevalent in property settlement agreements or litigated distribution and award scenarios. Our goal is to provide the business advice to our clients that will enable decision-making that enhances their economic outcomes.
Litigation
When disputes arise that require legal intervention to resolve, we provide strong and effective representation in litigation designed to reach a favorable result quickly and efficiently. We handle all manner of business disputes, from breach of contract to fraud, trademark infringement, and unfair competition. In our probate and estate administration practice, we litigate issues ranging from will contests to lawsuits against the executor or administrator of an estate for a breach of trust or fiduciary duty. Our attorneys are strong advocates for clients in contested divorce matters, litigating important family law issues including child custody, support, and property division. Our firm is experienced in handling disputes at both the trial and appellate levels as needed.
Appellate Advocacy
As experienced litigators, we are sensitive at the trial level of the possibility of an appeal taken by either side, and we work to preserve a proper trial record in the event of an appeal. Whether petitioning for or responding to an appeal, we undertake thorough and detailed preparation and are ready to advocate our client’s case on the briefs or through oral argument in appellate court.
Mediation
A mediator is a person who is trained to facilitate communication between parties and get them to see and understand the interests which lay behind the positions each side has taken, with the goal of building consensus and bringing the parties together to reach an agreement on the issues at hand.
Criminal Law
If you are facing both criminal charges and dealing with a difficult family law matter, the attorneys at The Hawkins Law Firm can help. Having the same attorney involved in both cases provides reassurance that both cases will be handled with the experience that ensures a winning strategy.
